WebOnce you're out of FMLA, you're at their mercy. You ONLY get 12 weeks per 12 months (or 60 days, assuming you regularly work a 5 day week). The vast majority of employers use a rolling 12 month calendar. Every FMLA day you use intermittently for before birth is FMLA you cannot use after birth.
